A transport company in the Netherlands has been ordered to pay a €280 fine following an incident where one of its trucks, laden with 35,000 liters of milk, proceeded through a red traffic light on the N35 in Zwolle. The company contended that executing an emergency stop was not feasible or safe, citing the substantial weight of the vehicle combination and the potential for the trailer to jackknife.
However, the Arnhem-Leeuwarden Court of Appeal rejected this argument, ruling that the heavy load did not excuse the driver from adhering to traffic signals. This decision underscores the legal expectation for commercial vehicle operators to maintain control and comply with traffic laws, even when transporting challenging cargo.
For freight forwarders and logistics operators, this ruling highlights the importance of driver training and route planning that accounts for vehicle dynamics and cargo weight. It reinforces that safety protocols and legal compliance must always take precedence, even when perceived operational challenges arise. This could lead to increased scrutiny on driver behavior and potentially influence training programs to better prepare drivers for such scenarios, ensuring they understand their legal obligations regardless of cargo type or weight.
