The North Holland District Court has found the director of the defunct transport firm Hanzade B.V. personally responsible for the shortfall in the company's bankruptcy assets. A preliminary payment of €500,000 has been mandated to the curator. This ruling stems from the company's prolonged failure to submit annual financial statements, maintain adequate administrative records, and a substantial customs debt amounting to €4.5 million.
For freight forwarders and logistics professionals, this case highlights the critical importance of robust financial management and compliance with regulatory obligations, especially customs duties. Failures in these areas can lead to severe financial penalties and personal liability for company directors, impacting the stability and operational continuity of transport partners. Such incidents can also result in disruptions to supply chains if a carrier or logistics provider faces bankruptcy due to non-compliance.
