A court in Rotterdam has determined that a road transport company is responsible for the loss of a shipment comprising 26 pallets of solar panels. The incident occurred after the cargo was loaded onto a truck on June 15, 2023, but subsequently failed to reach its destination. The court has calculated the total damages at 66,742 euros. This amount will be offset against any outstanding transport invoices owed by the client to the carrier.
For freight forwarders and operations managers, this ruling underscores the critical importance of robust cargo insurance and clear contractual agreements regarding carrier liability. Such incidents highlight the financial risks associated with cargo loss, even for seemingly straightforward road transport. Forwarders should ensure their clients understand the scope of carrier liability under conventions like CMR and consider additional insurance to cover the full value of high-value goods. This case also emphasizes the need for thorough vetting of transport partners and stringent tracking procedures to mitigate risks of disappearance.
