The College of Appeal for Business (CBb) in the Netherlands has determined that Transport en Logistiek Nederland (TLN) has the right to have its objection against Amsterdam Schiphol Airport's tariffs and operating conditions for the 2025-2027 period reviewed. This ruling reverses a previous decision by the Authority Consumers & Markets (ACM), which had declared TLN's application inadmissible.
Conversely, the appeal lodged by Fenex, a different industry association, was not accepted by the court. This indicates a distinction in how the court views the standing of different organizations to challenge airport regulations.
For freight forwarders and logistics operators, this decision means that TLN, representing a significant portion of the Dutch transport sector, can now actively engage in the process of scrutinizing Schiphol's future pricing and operational terms. While the immediate impact on air cargo rates or capacity is not direct, successful advocacy by TLN could potentially influence the cost structure for airfreight operations at Schiphol, a major European hub.
