The dismissal stemmed from the discovery of multiple packages, with a combined value of around 9,000 euros, still present in his truck. These packages were several days overdue for delivery.
Despite the upheld dismissal, the subdistrict court judge ruled that the driver is entitled to a transition payment. This indicates that while the immediate termination was deemed justified due to the severe breach of duty, the circumstances did not entirely negate the employer's obligation for a severance-like payment.
